Terms of Service

By creating a LinkStacked account, accessing the platform, or using any feature of the Service — including public profile pages as a visitor — you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and all supplementary policies incorporated by reference.

We may update these Terms from time to time. Material changes will be communicated via email or an in-dashboard notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

You must be at least 13 years old to use LinkStacked. If you are between 13 and 18 (or 16 in the EU for data-processing consent), you may only use the Service with the knowledge and consent of a parent or legal guardian.

By using the Service, you represent that you are legally authorised to enter this agreement in your jurisdiction and that you are not subject to sanctions or export restrictions that would prohibit your access.

You must provide accurate, complete, and current information when creating your account. You are responsible for:

• Maintaining the security and confidentiality of your login credentials
• All activity that occurs under your account, whether authorised by you or not
• Notifying us immediately at security@linkstacked.com if you suspect unauthorised access

You may not:

• Share account credentials with any other person
• Create accounts via automated means, bulk scripts, or third-party mass-registration services
• Register a username that impersonates another person, brand, or organisation
• Create multiple accounts to evade enforcement actions applied to a prior account

We reserve the right to suspend or terminate accounts that contain false information or that are used in violation of these Terms.

Your use of LinkStacked is subject to our full Acceptable Use Policy and Community Guidelines. In summary, you must not use the Service to:

• Scrape, crawl, or harvest data from the platform without written permission
• Publish links to malware, phishing sites, illegal content, or fraudulent schemes
• Impersonate any person, organisation, or brand
• Send unsolicited commercial messages or spam
• Circumvent technical access controls, rate limits, or bot-detection measures
• Engage in any activity that harms the platform, its infrastructure, or other users

You retain ownership of all content you upload or create on LinkStacked — your bio, links, product listings, images, and descriptions ("User Content"). By posting User Content, you grant Devpitch UG (haftungsbeschränkt) a worldwide, non-exclusive, royalty-free licence to host, store, display, transmit, and distribute your User Content solely for the purpose of operating and improving the Service.

This licence ends when you delete the content or close your account (subject to the retention periods in our Privacy Policy).

You are solely responsible for your User Content. We do not endorse it, and we are not liable for it. By posting User Content, you represent that:

• You own it or have all necessary rights and permissions to share it
• It does not infringe any third-party intellectual property, privacy, or other rights
• It complies with all applicable laws and these Terms

LinkStacked enables creators to sell digital products, theme files, and product bundles, and to receive tips from visitors. All payment processing is handled by Stripe. Creators who wish to receive payments must connect a Stripe account and agree to the Creator & Seller Terms and Stripe's Connected Account Agreement.

LinkStacked acts as a technology platform, not as a seller, buyer, or merchant of record for creator-to-visitor transactions. When you purchase a digital product or send a tip:

• The contract for sale is between you (the buyer) and the creator (the seller)
• LinkStacked facilitates the transaction and payment but is not party to that contract
• Creators are solely responsible for the accuracy of their product descriptions, delivery of files, and compliance with applicable consumer and tax laws
• LinkStacked is not responsible for the quality, legality, or fitness for purpose of creator products

• Paid plans are billed in advance on a monthly or annual basis in the currency displayed at checkout.
• All subscription fees are non-refundable except where required by mandatory consumer law or as stated in our Refund Policy.
• If you downgrade your plan, the change takes effect at the end of your current billing period. You retain access to paid features until then.
• If you cancel, your subscription terminates at the end of the period you have paid for. No partial refunds are issued.
• We reserve the right to change subscription prices with at least 30 days' written notice. Price changes do not apply retroactively to your current billing period.
• Accounts with unpaid invoices may be suspended after a 7-day grace period.

Each LinkStacked profile is assigned a permanent QR code that resolves to your profile URL. This QR code never changes, regardless of username changes or domain updates — it is a core part of the service promise.

Creators may connect a custom domain (e.g. links.yourbrand.com) via our domain verification flow. You are responsible for maintaining your domain registration and DNS configuration. We will make reasonable efforts to maintain SSL/TLS certificates via our automated certificate infrastructure, but cannot guarantee certificate issuance if your DNS records are incorrect.

The LinkStacked name, logo, platform software, design system, and all content created by Devpitch UG are the intellectual property of Devpitch UG (haftungsbeschränkt) and are protected by applicable copyright, trademark, and other laws.

You may not:

• Copy, modify, distribute, or create derivative works from our software without prior written permission
• Use the LinkStacked name or logo in a way that implies affiliation, endorsement, or sponsorship without our written consent
• Reverse-engineer, decompile, or disassemble any part of the platform

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or free from harmful components
• Any defect or error will be corrected
• The Service will meet your specific requirements
• Any content or product sold by a creator is accurate, complete, or fit for purpose

To the maximum extent permitted by applicable law — including mandatory consumer protection rights that cannot be waived — Devpitch UG (haftungsbeschränkt) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising under these Terms or from your use of the Service shall not exceed the greater of: (a) the amount you paid to LinkStacked in the 12 months preceding the claim, or (b) EUR 100.

You may delete your account at any time via Settings → Data → Danger zone. Deletion is permanent and initiates within 24 hours.

We may suspend or terminate your account — with or without notice — if you violate these Terms, engage in fraud, or present a risk to the platform or other users. For serious violations (fraud, CSAM, active malware distribution), termination is immediate and no cure period is offered.

Upon termination: your right to access the Service ceases immediately; pending payouts may be withheld pending investigation; Sections 5, 10, 11, 12, and 14 survive termination.

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

Any dispute arising from these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts of Berlin, Germany.

For EU consumers: nothing in these Terms prevents you from bringing proceedings in the courts of your country of residence, or from using the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
