How we handle copyright and intellectual property on LinkStacked — takedown requests, counter-notices, and our repeat infringer policy.

Platform intellectual property

The LinkStacked name, logo, platform software, design system, UI kit, original marketing content, and all platform-specific creative work are the intellectual property of Devpitch UG (haftungsbeschränkt) and its licensors.

You may not use our trademarks, trade dress, or copyrighted materials without our prior written permission. Use of the LinkStacked logo in third-party press, reviews, or integrations must comply with our brand guidelines (available on request at legal@linkstacked.com).

User content & intellectual property

Creators on LinkStacked own their own content. When you publish content on the platform, you grant us a limited hosting licence (described in the Terms of Service) — you do not transfer ownership.

You are responsible for ensuring that content you post — including bios, link thumbnails, product images, product files, and custom CSS — does not infringe third-party intellectual property rights.

  • Use only images and media you own, have a licence for, or that are in the public domain
  • If you use Creative Commons or similar licenced content, comply with the attribution requirements of the specific licence
  • Do not upload files or digital products containing third-party software, fonts, or content you do not have the right to redistribute
  • AI-generated content: ensure the generative AI service you used allows commercial use and redistribution of outputs

DMCA takedown notices

If you are a copyright owner (or authorised agent) and believe that material on LinkStacked infringes your copyright, you may submit a DMCA takedown notice. Your notice must include:

  1. A description of the copyrighted work you believe has been infringed
  2. The URL of the allegedly infringing material on LinkStacked
  3. Your name, address, telephone number, and email address
  4. A statement that you have a good faith belief that use of the material is not authorised by the copyright owner, its agent, or the law
  5. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf
  6. Your physical or electronic signature

Upon receipt of a valid notice, we will: (1) remove or disable access to the allegedly infringing material, (2) notify the uploader, and (3) provide the uploader with an opportunity to file a counter-notice.

Counter-notices

If your content was removed in response to a DMCA takedown notice and you believe the removal was erroneous or the result of misidentification, you may submit a counter-notice. Your counter-notice must include:

  1. Your name, address, telephone number, and email address
  2. Identification of the removed material and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Germany, for non-US residents) and that you will accept service of process from the person who submitted the takedown notice
  5. Your physical or electronic signature

Submit counter-notices to legal@linkstacked.com with subject: DMCA Counter-Notice.

Upon receipt of a valid counter-notice, we will forward a copy to the original complainant. If the complainant does not file a court action within 10–14 business days, we will restore the removed material.

Repeat infringer policy

Under applicable law and as our policy, we will terminate accounts of users who are repeat copyright infringers. An account is considered a repeat infringer if:

  • Two or more valid (uncontested) DMCA takedown notices have been filed against content on the account in a 12-month period, or
  • Three or more valid DMCA takedown notices have been filed against the account at any time

Creators who receive a first takedown notice receive a warning. A second notice triggers account review. A third notice results in permanent termination. Counter-notices that are sustained do not count toward the repeat infringer threshold.

Trademark complaints

If you believe a LinkStacked creator is infringing your registered trademark — through username, display name, domain, or profile content — you can report it as impersonation via the profile report form or by emailing legal@linkstacked.com with subject: Trademark Complaint.

Please include:

  • Your name and contact information
  • Details of the registered trademark (registration number, jurisdiction, description of mark)
  • The URL of the allegedly infringing LinkStacked profile
  • An explanation of why you believe the profile infringes your trademark
  • A statement of good faith and accuracy
  • Your signature (physical or electronic)

We review trademark complaints within 5 business days and may remove infringing content, require a username change, or terminate an account depending on the severity of the infringement.
